Overview

This page sets out the terms of use (“Terms”) under which you (“You”) may access and use the website and any associated applications of Auzworld Migration and Lawyers (collectively, “our websites and apps”). Please read these Terms carefully as they affect Your rights and obligations at law. If You do not agree to these Terms, please do not register for an account or use our websites and apps.

Auzworld Migration and Lawyers is an Australian legal practice based in Sydney, New South Wales, that provides legal services in Australian immigration law and related areas, including conveyancing, civil litigation, and family law. Our team includes Australian Legal Practitioners and Registered Migration Agents.

Important notice: The content published on our websites and apps is general information only and does not constitute legal advice. It does not take into account your personal circumstances. For advice specific to your matter, you should obtain a formal written engagement with our firm or consult another qualified legal practitioner or Registered Migration Agent.

Binding Agreement and Variations

  • Our websites and apps are provided to You for Your use subject to these Terms. These Terms form a binding agreement between You and Auzworld Lawyers Pty Ltd (ABN 26 671 444 107), trading as Auzworld Migration and Lawyers. By accessing or using our websites and apps, You agree to accept and be bound by these Terms.
  • We may update these Terms from time to time, and the updated version will apply to You. The current version of these Terms will always be accessible through our websites and apps.
  • If we reasonably believe that changes to these Terms will be materially detrimental to Users, we will post a notice on our websites and/or apps at least 30 days prior to the changes taking effect.
  • If You do not wish to accept the updated Terms, You should cease using our websites and apps. Continued use will indicate Your agreement to be bound by the updated Terms.
  • Your use of any services we provide (including legal services delivered under a costs agreement or retainer) may be subject to a separate client engagement agreement with Auzworld Lawyers Pty Ltd. In the case of any conflict between these Terms and any such client engagement agreement, the terms of the client engagement agreement will prevail in respect of that engagement.

No Legal Advice and No Lawyer–Client Relationship

  • Information published on our websites and apps, including articles, blog posts, case updates, FAQs, checklists, visa guides, fact sheets, and similar content, is provided for general informational purposes only. It is not legal advice and should not be relied on as a substitute for obtaining professional advice tailored to your circumstances.
  • Australian immigration law, case law, and Department of Home Affairs policy change frequently. Although we take reasonable steps to keep content up to date, we do not warrant that any content is current, complete, or accurate at the time You access it.
  • Your use of our websites and apps, including completing a contact form, subscribing to updates, booking a consultation, or sending us a message, does not by itself create a lawyer–client or migration agent–client relationship. A professional relationship is established only when we have undertaken a conflict check, agreed to act for You in writing, and You have signed our costs agreement or engagement letter.
  • Please do not send confidential or sensitive information through our websites or apps until a formal engagement has been accepted by our firm. Unsolicited information may not be treated as confidential and may not give rise to legal professional privilege.

Professional Standards and Regulation

  • Our solicitors are admitted to practise in New South Wales and are regulated by the Legal Profession Uniform Law (NSW) and by the Law Society of New South Wales.
  • Our Registered Migration Agents are regulated by the Office of the Migration Agents Registration Authority (OMARA) and comply with the Migration Agents Code of Conduct.
  • We maintain professional indemnity insurance in accordance with applicable regulatory requirements.

Registration

  • To register an account on our websites and apps, You must be capable of entering into a legally binding contract in the country in which You reside.
  • You must ensure that the details You provide to us on registration (or at any time afterwards) are true, correct, and complete.
  • You must inform us promptly of any changes to the information You provided when registering, by updating Your details so that we can communicate with You effectively and provide accurate advice.

Password and Security

  • When You register an account through our websites and apps, You will be asked to create a password. You may also be able to register using a single sign-on service such as Google, Apple, or Microsoft (“Login Details”). To prevent fraud, You must keep Your Login Details confidential and must not disclose or share them with anyone. You agree to notify us immediately of any unauthorised use of Your Login Details or any other breach of security relevant to us.
  • If we have reason to believe that there is likely to be a breach of security or misuse of our websites and apps, we may require You to change Your Login Details or we may suspend Your account.
  • You are entirely responsible for maintaining the confidentiality of Your Login Details and for all activities that occur through Your account. You may change Your password at any time through the account settings.
  • If You do not maintain the confidentiality of Your Login Details:
    • all resulting direct losses or damage incurred by You or us shall be borne by You; and
    • You shall indemnify us for any loss or damage suffered by us as a direct result of Your Login Details being compromised, except to the extent that we contributed to such loss or damage.

Intellectual Property

  • Auzworld Lawyers Pty Ltd owns, or is licensed to use, all intellectual property rights associated with our websites and apps, including all text, articles, guides, templates, logos, branding, graphics, and design elements.
  • We do not claim ownership of any pre-existing intellectual property owned by You (for example, Your company logo or documents You upload). You grant us a non-exclusive, royalty-free licence to use Your intellectual property solely to the extent necessary to provide our services to You. If You withdraw this licence, we may be unable to continue providing certain services.
  • Unless otherwise expressly permitted by us in writing, the materials and Content on our websites and apps must only be used for Your personal, non-commercial purposes. You must keep intact all copyright and proprietary notices. You may not reproduce, modify, copy, distribute, republish, or use for commercial purposes any materials or Content on our websites and apps without our prior written permission.
  • We welcome feedback about our websites, apps, and services. You agree that we may use, reproduce, and adapt any ideas, suggestions, or feedback You submit to us without any obligation to compensate You. If required by law, You will formally transfer any intellectual property or other rights in such feedback to us for nominal consideration.
  • Our websites and apps may incorporate open-source software, which is used in accordance with its applicable licences.

Availability of Our Websites and Apps

  • Although we aim to offer You the best service possible, we make no promise that our websites and apps will meet Your requirements.
  • We cannot guarantee that our websites and apps will be uninterrupted, fault-free, error-free, or that our servers are free of viruses or other harmful code. If You experience a fault, please report it to us and we will attempt to correct it as soon as reasonably practicable.
  • Your access to our websites and apps may be restricted from time to time to allow for repairs, maintenance, or the introduction of new content or features. We will attempt to restore access as soon as we reasonably can.
  • You understand that we cannot guarantee that files available through our websites and apps, or delivered via email through our websites and apps, will be free of viruses, worms, trojan horses, or other destructive code. You are responsible for implementing appropriate protective measures and for maintaining external backups of any important data.

Your Use of Our Websites and Apps

  • We grant You a limited, terminable, non-exclusive right to access and use our websites and apps for Your personal use and for the purpose of engaging or considering engaging our legal or migration services.
  • You may not use our websites and apps for any of the following purposes:
    • disseminating any unlawful, discriminatory, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material, or otherwise breaching any law;
    • aggregating, copying, or duplicating any Content or information available from our websites and apps;
    • reproducing any Content for general circulation or commercial purposes;
    • linking to any Content on our websites and apps without our prior written permission, other than a normal hyperlink to our home page;
    • transmitting material that encourages conduct constituting a criminal offence or otherwise breaches any applicable law, regulation, or professional code;
    • interfering with any other person’s use or enjoyment of our websites and apps; or
    • impersonating any other person, including any solicitor, migration agent, or staff member of our firm.
  • You agree not to resell, sublicense, or assign Your rights or obligations under these Terms, and not to make any unauthorised commercial use of our websites and apps.
  • You may not use data mining, robots, screen scraping, or any similar automated data-gathering, extraction, or publication tools in connection with our websites and apps, except with our prior written consent.

Your Use of Our Services

All Users agree not to:

  • transmit, post, distribute, store, or destroy any material, including any Content, in violation of any applicable law or regulation, including laws governing the collection, processing, or transfer of personal information, or in breach of our Privacy Policy;
  • violate or attempt to violate the security of our websites and apps, including:
    • accessing data not intended for them;
    • logging into a server or account that they are not authorised to access;
    • probing, scanning, or testing the vulnerability of any system or network;
    • breaching security or authentication measures without proper authorisation;
    • interfering with service to any user, host, or network; or
    • sending unsolicited emails, including advertisements or promotional material;
  • reverse engineer, decompile, or disassemble any part of our websites and apps;
  • aggregate, copy, or duplicate any Content or information available from our websites and apps, other than as expressly permitted by these Terms or another agreement with us;
  • post any content that:
    • facilitates, promotes, or endorses scams, misleading information, or illegal activities;
    • provides instructional information about illegal activities (for example, document fraud, identity fraud, or circumventing immigration controls);
    • promotes political views or candidates; or
    • seeks to procure legal services through false or misleading representations;
  • submit any application, inquiry, or document on behalf of another party without that party’s clear authority;
  • share login credentials with any third party;
  • post or submit any inaccurate, incomplete, misleading, false, or outdated information, including personal details, identity documents, or information relevant to a visa or legal matter;
  • post content that contains restricted-access or password-protected pages, or hidden pages or images;
  • solicit Login Details, personal data, or confidential information from other Users;
  • delete or alter any material posted by any other person or entity;
  • harass, incite harassment of, or advocate harassment against any group, firm, or individual;
  • send unsolicited communications to Users who have requested not to be contacted;
  • attempt to interfere with service through viruses, overloading, flooding, spamming, or crashing; or
  • use our services for any unlawful purpose, or post content that is defamatory, offensive, vulgar, obscene, threatening, harassing, abusive, hateful, racist, or discriminatory.

Violations of system or network security may result in civil and/or criminal liability. Auzworld Lawyers Pty Ltd will investigate suspected violations and may cooperate with law enforcement authorities in prosecuting Users involved in such conduct.

Additional Terms Applicable to Users

  • If You are a User (including a prospective, current, or former client, or a visitor who creates an account), this section applies to You.
  • We grant You a limited, terminable, non-exclusive right to access and use our websites and apps for the purpose of learning about our services, booking a consultation, submitting an enquiry, or communicating with us about an existing matter. You may view and download a single copy of Content solely for Your personal, non-commercial use.
  • When registering or submitting an enquiry, You must provide accurate information, including a valid email address and, where requested, other contact details.
  • Your account details and any profile You create must be accurate, complete, up to date, and not misleading. You must not impersonate another person.
  • You acknowledge that You are solely responsible for:
    • the form, content, and accuracy of any information, documents, or instructions You provide; and
    • any consequences arising from Your account creation and use of our services, including any consequences of providing inaccurate information to us or to the Department of Home Affairs.
  • We may, from time to time, offer additional services or referrals to third-party service providers (for example, translators, education providers, or health insurers) based on the preferences You identify. Any engagement of those third parties is between You and the third party.
  • Please see our Privacy Policy for information about how we handle personal information. We may be required to disclose information to regulatory bodies, law enforcement, or other authorities in accordance with applicable law.
  • You have no ownership rights in Your account with us. If You cancel Your account or we terminate it:
    • Your account information will be marked as deleted on our systems;
    • data may remain temporarily available due to backup cycles or propagation delays; and
    • we will retain client files and records for the period required by the Legal Profession Uniform Law, regulatory obligations, and our professional indemnity insurance, regardless of account deletion.
  • We may deactivate inactive accounts after a prolonged period of inactivity.
  • We do not guarantee:
    • the continued availability of any service, publication, or webinar listed on our websites and apps; or
    • that every piece of information published by us is fully aligned with the most recent updates from the Department of Home Affairs, Administrative Review Tribunal, courts, or other regulatory bodies at the time You read it.

User Content and Submissions

  • You understand that all User Content is the sole responsibility of the person from whom such User Content originated.
  • All information You provide to us through our websites and apps, including account details, enquiry forms, and uploaded documents, will be stored in our databases and handled in accordance with our Privacy Policy.
  • You consent to Your information being transferred, stored, or processed outside Your location where necessary to provide our services (see our Privacy Policy for further details).
  • By posting or submitting User Content, You grant Auzworld Lawyers Pty Ltd a worldwide, non-exclusive, royalty-free licence to reproduce, adapt, distribute, and publish such Content to the extent necessary to operate our websites and apps and provide our services, subject to applicable privacy laws and any applicable client confidentiality obligations. This licence ends when the Content is removed, except where the Content has been used in a way that cannot reasonably be reversed.
  • Publicly posted User Content (for example, reviews or public-facing comments) may be accessed, stored, and reproduced by other Users for personal, non-commercial use.
  • We may remove any User Content that, in our reasonable opinion, violates these Terms, infringes any law, or threatens the safety of any person.
  • We do not guarantee the truthfulness or accuracy of User Content, including testimonials or reviews posted by third parties. Reliance on User Content is at Your own risk.

Our Right to Suspend or Cancel Your Account

  • We may suspend Your account immediately for conduct we reasonably consider unlawful, inappropriate, or in breach of these Terms. We may cancel Your account for a material breach of these Terms that is not remedied within 14 days of notice from us.
  • You may cancel Your account at any time by contacting us in writing.
  • Suspension or cancellation of Your account does not affect any statutory rights or any existing professional obligations we owe to You as a client (for example, our obligation to maintain and, where required, release client files).

Term and Termination

  • These Terms remain effective while You access or use our websites and apps.
  • We may pursue any legal remedies available to us for breaches of these Terms, including:
    • removing User Content;
    • terminating accounts; and
    • restricting access to our websites, apps, or services.
  • Clauses that by their nature are intended to survive termination (including clauses on intellectual property, liability, indemnity, and governing law) will continue to apply after termination.

Our Liability

  • Our websites and apps operate as a platform for:
    • prospective and existing clients to learn about our services and book consultations regarding their legal or migration matters;
    • Users to create accounts and communicate with us;
    • the publication of general legal and migration updates, articles, and resources sourced from publicly available information and our internal analysis.
  • To the maximum extent permitted by law, and subject to any rights You may have under the Australian Consumer Law or other consumer protection legislation that cannot be excluded, we are not responsible for:
    • the quality, safety, accuracy, or legality of User Content;
    • decisions made by the Department of Home Affairs, the Administrative Review Tribunal, courts, or other decision-makers;
    • processing times, policy changes, or legislative amendments introduced by government bodies;
    • the accuracy of general information or third-party content appearing on our websites and apps; or
    • any action You take in reliance on general information published on our websites and apps without first obtaining formal legal advice.
  • You should seek formal, written legal advice before entering into any legally significant agreement or lodging any application based on information You have read on our websites and apps.
  • We may remove User Content at our discretion where we consider it necessary to do so.
  • While we take reasonable steps to ensure accuracy, we do not warrant the correctness of any third-party content linked to or republished on our websites and apps.
  • You assume all risks of dealing with other Users (including any in-person interactions arranged through or introduced via our websites and apps).
  • No content on our websites and apps constitutes our endorsement of any User, product, or third party.
  • While we implement reasonable security measures, we disclaim liability for unlawful third-party access to information transmitted to or stored on our websites and apps, to the extent permitted by law.
  • Our liability for loss is limited to direct, reasonably foreseeable loss and does not extend to loss of profits, loss of data, loss of opportunity, loss of goodwill, or indirect or consequential loss.
  • Where any liability cannot be excluded but can be limited, our liability is limited, at our option, to the re-supply of the relevant service or the refund of the fees paid to us for that service.
  • Our aggregate liability under or in connection with these Terms is capped at AUD 100, to the extent permitted by law. This cap does not apply to our obligations to clients under a signed costs agreement, which are governed by that agreement and by applicable law.

Disclaimers

  • We accept no liability for loss of information, data, or user submissions arising from service interruptions, technical faults, or events beyond our reasonable control.
  • We do not exercise editorial control over third-party communications, comments, or submissions posted on our websites and apps.

Third-Party Websites

Our websites and apps may contain links to third-party websites, including Department of Home Affairs pages, court and tribunal websites, news outlets, and partner organisations. These websites are not under our control, and we are not responsible for their content, accuracy, legality, or availability. The inclusion of any link does not imply our endorsement of the linked site or of its operators.

Advertising and Sponsorship

  • Parts of our websites and apps may contain advertising or sponsored content. Advertisers and sponsors are solely responsible for ensuring that their materials comply with all applicable laws, including the Legal Profession Uniform Law advertising rules and the Australian Consumer Law.
  • We may refuse any advertisement we consider unsuitable or inconsistent with the values or professional standing of the firm.
  • We accept no responsibility for errors or inaccuracies in advertising or sponsored content.

Indemnity

You agree to indemnify Auzworld Lawyers Pty Ltd, its directors, solicitors, employees, and contractors against all losses, damages, costs, and expenses arising from:

  • Your User Content;
  • Your use of any Content obtained from our websites and apps; and
  • Your breach of these Terms or any applicable law,

except to the extent that we caused or contributed to such loss. We will notify You of any claim for which indemnity is sought.

Contracting Parties and Governing Law

  • Your contractual relationship in relation to these Terms is with Auzworld Lawyers Pty Ltd (ABN 26 671 444 107), trading as Auzworld Migration and Lawyers.
  • These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and of any courts competent to hear appeals from those courts.
  • We may assign, novate, or transfer these Terms to a related entity or successor in business without Your consent, on the giving of 30 days’ notice, provided Your rights are not materially affected.

International Use and Translations

  • Our websites and apps are operated from Australia. We do not warrant that materials on our websites and apps are appropriate or lawful for use in any location outside Australia. Access from territories where such access is prohibited is unauthorised.
  • Where any translated version of these Terms or other Content is provided, the English-language version prevails in the event of any inconsistency.

Complaints

If You have a concern about our services or the conduct of any of our solicitors or Registered Migration Agents, please contact our office in the first instance so that we can try to resolve the matter with You directly.

  • Complaints about solicitors may also be made to the Office of the Legal Services Commissioner (NSW).
  • Complaints about Registered Migration Agents may be made to the Office of the Migration Agents Registration Authority (OMARA).

Miscellaneous

  • You may not transfer Your rights or obligations under these Terms. We may transfer ours where Your rights are not materially affected.
  • Our failure to enforce any breach of these Terms does not waive our right to enforce the same or any other breach in the future.
  • We are not liable for any breach of these Terms caused by circumstances beyond our reasonable control, including acts of government, industrial action, natural disasters, cyber-attacks, or failures of telecommunications or internet service providers.
  • If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect.

Definitions

  • “Content” means all text, graphics, designs, data, images, audio, video, articles, case notes, guides, templates, and other material published on our websites and apps.
  • “Registered Migration Agent” means a person registered with the Office of the Migration Agents Registration Authority (OMARA) to provide immigration assistance in Australia.
  • “Services” means any services offered through or referenced on our websites and apps, including general information, consultation bookings, and the legal and migration services offered by Auzworld Migration and Lawyers.
  • “Solicitor” means an Australian Legal Practitioner holding a current practising certificate in an Australian jurisdiction.
  • “User” means any person accessing our websites and apps, whether as a visitor, prospective client, existing client, or registered account holder.
  • “User Content” means all materials, information, documents, messages, reviews, and submissions provided by Users through our websites and apps.
